Zoetrope Art - Terms of Service & Client Agreement

1. Overview

This agreement outlines the terms of service for custom design services, including coat of arms, logos, and monograms, as well as optional copyright registration offered by Zoetrope Art ("the Designer"). By purchasing any design services, the client ("the Client") agrees to the following terms.

2. Ownership & Copyright Registration

• All custom coat of arms, logos, and monograms are original works and are owned by the Client upon final delivery and payment.

• If the Client purchases copyright registration, the Designer will file the application with the U.S. Copyright Office under the Client’s name. The Client will receive an official copyright certificate once processed.

• The Designer retains the right to display completed works in portfolios, marketing materials, and social media, unless the Client requests confidentiality in writing.

3. Payment & Fees

• Full payment is required upfront before any design work begins.

• Pricing Structure:

  • Coat of Arms Design: $250

  • Copyright Registration (Optional): +$125 (includes filing fee)

4. Refunds & Cancellations

• Design fees are non-refundable once work has begun.

• If the Client cancels before the final design is delivered, the Designer retains ownership of all unused drafts and sketches.

• If a copyright application is submitted, no refunds are available as filing fees are paid to third-party agencies.

5. Revisions & Modifications

• Each project includes up to two (2) rounds of revisions before final approval.

• Additional revisions will be billed at an hourly rate of $50/hour.

• Once a design is finalized and delivered, any further modifications will require a new service request.

6. Liability & Indemnification

• The Designer is not responsible for denied copyright applications due to submission errors or other unforeseen circumstances.

• The Designer is responsible for ensuring that the Client coat of arms does not infringe upon any existing copyrights. This will be discussed once booked, and interest form has been submitted.

• The Designer is not liable for any legal disputes regarding the use of the coat of arms, logo, or monogram after delivery.

7. Confidentiality

• All client information and project details will be kept strictly confidential, except for portfolio use (unless requested otherwise in writing).

8. Agreement Acceptance

By purchasing a design from Zoetrope Art, the Client agrees to these Terms of Service. This agreement is binding upon full payment.
